You work 40 hours a week on average, so you expect that’s what you’ll make for one week’s paid vacation. Instead, you’re compensated for 32 hours of work.
You want to know, is this legal?
According to New York State Labor Law, it is.
Employers are not obligated to pay employees for time not actually worked – for example, sick or vacation time – unless there is a company policy to that effect.
And when your employer does establish a benefit policy, he or she can impose conditions as they choose.
