Syracuse (WSYR-TV) -- One of our viewers lives in an apartment complex where secondhand smoke is a problem. She says smokers in neighboring units have caused her respiratory problems, not to mention, her belongings smell like smoke. What are my rights, she asks?
Landlords may, but are not required, to adopt policies that would prevent smoking in common areas and individual units. However, what they must do is prohibit smoking in any indoor place of employment. So, any area where your landlord employs cleaning crews or other staff has to remain smoke-free.
As for drifting smoke from other apartments, you can always ask your neighbors to help reduce your exposure.
