Utica (WSYR-TV) – An ex-State Trooper accused of breaking into a Utica home and fighting with a resident has been indicted.

31-year-old Jesse Miller was indicted on charges including criminal mischief in the third degree, a felony; and also criminal trespass in the second degree, criminal mischief in the fourth degree, and two counts of assault in the third degree, all misdemeanors.

He is scheduled to be arraigned in Oneida County Court on Wednesday, May 9.

According to Utica Police, Miller was intoxicated when he kicked in the door of someone’s home. Once inside, a fight broke out. Police say Miller bit the homeowner during the incident, and the homeowner struck the off-duty officer with a hammer.

Miller’s attorney said that the ex-trooper was so drunk that he thought he had arrived at his own home when the incident erupted.
