SYRACUSE, NY (WSYR-TV) - The father of two brothers arrested last month in a scratch off lottery scam, has been arrested on a conspiracy charge.
The Onondaga County District Attorney, says 56-year old Nayef Ashkar was arrested earlier this week.
D.A. Bill Fitzpatrick says Nayef Ashkar knew the ticket was stolen and encouraged his son Andy Ashkar to scam the rightful winner out of the five million dollar ticket.
Andy and Nayel Ashkar are charged with attempted grand larceny and conspiracy charges. Andy is also charged with criminal possesion of stolen property.
In 2006, investigators say the legitimate winner bought the winning ticket at the Green Ale Market in Syracuse, which is owned by the Ashkar family.
Fitzpatrick says Andy was working at the register that day and when the winner went to cash the ticket in, he told him the ticket was only a five thousand dollar winner. Andy paid him off and kept the ticket for himself.
It was not until March of this year, that the Ashkar brothers contacted the lottery office wanting to cash in the five million dollar ticket, saying they bought it from their family's store.
Lottery officials questioned their story from the start and began an investigation with the district attorney's office.
