Former lawmaker could be heading back to court
Syracuse (WSYR-TV) – Former State Senate Majority Leader Joe Bruno could be headed back to court for a retrial.
On Tuesday, Bruno lost an appeal to dismiss charges that he accepted bribes while he was in office.
His original conviction in 2009 was overturned when part of the charge he faced was ruled unconstitutional by the U.S. Supreme Court.
Bruno's lawyers argued that a new trial would violate his rights against double jeopardy.
The court ruled that prosecutors could file a new indictment with evidence that a bribe was involved.
A hearing has been scheduled for next week.
