Syracuse (WSYR-TV) – A man with a history of felony convictions has been indicted in a New Year’s Eve murder case.

34-year-old Fred Burgess, Jr., of Mains Avenue, is accused of trying to rob 30-year-old David Jones while he sat in an SUV on West Onondaga Street at around 11:30 p.m. on Jan. 31 when a struggle broke out.

According to police, Burgess shot Jones when he tried to drive off.

Burgess was indicted Thursday on charges of first degree murder, two counts of second degree murder, two counts of first degree attempted robbery, and criminal possession of a weapon.

Police say they have no reason to believe that Jones was doing anything illegal at the time of his death.
