Syracuse (WSYR-TV) – The non-jury trial of two brothers accused of swindling a Syracuse man out of a winning $5 million lottery ticket began in Onondaga County Court on Monday morning.
Andy and Nayel Ashkar are charged with conspiracy.
Last week, grand larceny charges against the brothers were dismissed
on the grounds that the statute of limitations had expired. According to the Onondaga County District Attorney’s office
, Andy Ashkar told the legitimate winner that a $5 million ticket was only worth $5,000 when he purchased it at the Ashkar family’s Green Ale Market on East Fayette Street.
In addition, the DA’s office says Ashkar told the legitimate winner that the store was entitled to a $1,000 cashing fee.
Several years later, the Ashkar brothers tried cashing the ticket, saying several factors delayed them from cashing it.
