DA’s Office appeals decision to retry man convicted of raping elderly woman

Syracuse (WSYR-TV) -- The Onondaga County District Attorney’s Office says it plans to appeal the decision to give a new trial to a convicted sex abuser.

Vincent Torres was sentenced to nearly 100 years in prison last year for sexually assaulting an elderly woman in her home.

Last week, a mid-level appeals court ruled he should get a new trial because his wife wasn’t in the courtroom during jury selection.

On Thursday, DA Bill Fitzpatrick says his office will try to get permission to appeal the decision. If they don’t get permission, Fitzpatrick says his office will retry Torres.
