Grand jury to hear case of WNY cop who killed son

HERKIMER, N.Y. (AP) - Prosecutors say a grand jury will consider the case of a police officer who says he fatally shot his son at an Adirondacks motel after mistaking him for an intruder.

The Herkimer County District Attorney's office tells the Utica Observer-Dispatch the panel will determine if there's evidence to support criminal charges against 59-year-old Michael Leach.

Police said Leach and his 37-year-old son Matthew were staying at Clark's Beach Motel in the village of Old Forge when the shooting happened just before 1 a.m. on July 21.

Michael Leach is an officer with the village of Perry Police Department in Wyoming County, 35 miles southwest of Rochester. Troopers said he used his department-issued handgun in the shooting.

He hasn't been charged so far. The grand jury is expected to meet soon.
