Judge says man accused of rape is fit to stand trial

Syracuse (WSYR-TV) – A man accused of giving away a 2-year-old child in Brooklyn is fit to stand trial on sex charges involving the child’s mother, according to a judge.

Damion Davis’ proceedings were interrupted when he went on a prolonged rant in court in January, prompting a psychiatric evaluation.

On Wednesday, Judge Anthony Aloi said that Davis is mentally competent to stand trial. Davis' trial is expected to begin on March 19.

Davis was initially believed to be the father of the missing child, named Qua’mere Rogers. The child was last seen in July 2007. In 2009, he was charged with child abandonment, but the charge was dropped due to lack of evidence. DNA evidence, however, revealed that the child had a different father.

He was living with the child’s mother – who was 15 at the time – when the child was born. Davis is facing rape  charges for having sex with a minor.

He is currently serving time behind bars after pleading guilty to charges stemming from a domestic incident.
Davis’ mental health has been examined on several occasions. Before being found guilty in the domestic incident, he was twice determined to be fit to stand trial.
