Syracuse (WSYR-TV) -- A man convicted of raping an elderly woman nine years ago is getting a new trial because of an issue involving his wife.

Vincent Torres was sentenced to almost 100 years behind bars after DNA evidence proved he sexually assaulted a 76-year-old woman in her Grant Village home.

On Friday, the State Supreme Court ruled that Torres should get a new trial because his was not able to sit in during jury selection due to an overcrowded courtroom.

Vincent was convicted of one count of burglary, one count of attempted sodomy, two counts of sodomy, one count of sexual abuse.
