OWEGO, N.Y. (AP) - A former Southern Tier businessman was released from custody after the state's highest court reversed his second conviction for the murder of his estranged wife 11 years ago.
A Tioga County judge ordered that 51-year-old Calvin Harris be released on a $500,000 property bond.
The Court of Appeals last week ordered a third trial for Harris, citing errors during his previous trial that ended in a second conviction for second-degree murder.
Harris was convicted in 2007 of the September 2001 slaying of his missing 35-year-old wife, Michele. He won a retrial after his first conviction when a new witness came forward. Harris was convicted again in 2009.
Michele Harris' body has never been found.
