Syracuse (WSYR-TV) – A Syracuse man who had been convicted and sentenced to nearly a century in prison is still free on bail after appearing in court on Friday.

Vincent Torres was convicted in May 2011 of raping an elderly woman in 2003. DNA evidence was collected in the case that saw him convicted of one count of burglary, one count of attempted sodomy, two counts of sodomy, and one count of sexual abuse.

On Friday, the Onondaga County District Attorney’s office was told in court that it will be allowed to appeal the decision overturning his conviction and 90-year prison sentence.

His conviction was overturned in July when State Supreme Court Justices ruled that he should get a new trial because his wife was not able to sit in during jury selection because the courtroom was too crowded.

He posted $100,000 after the ruling and has been free on bail since.
