Onondaga County DA plans to appeal overturned decision in DeLee transgender hate crime
Syracuse (WSYR-TV) – Onondaga County District Attorney William Fitzpatrick announced on Monday that his office plans to appeal to the New York State Court of Appeals after the Appellate Division, Fourth Department overturned the conviction of manslaughter in the first degree as a hate crime against Dwight DeLee.
In 2009, DeLee was sentenced in the November 2008 killing of 22-year-old Moses Cannon, a transgendered person who went by the name Latiesha Green.
The District Attorney’s office argued that because Cannon lived a life as a woman, he was killed because he was transgendered, making it a hate crime.
The Appellate Division found that there was an error in the judge's instructions to the jury and the verdict based on those instructions.
