Syracuse (WSYR-TV) - A town of Clay woman convicted of murdering her husband and attempting to kill her daughter will get a new court hearing.
The state Appellate Court issued a ruling Friday on Stacey Castor’s appeal. However, her conviction has not been overturned and Castor remains in prison. (

When Castor gave her fingerprints to police in September 2007, officers contacted her estate attorney. Because that attorney was not representing her in the case, Castor argued her right to council had been violated.
The Appellate Court stated that there should be a hearing in Onondaga County Court to consider that motion in her appeal. The original trial was in Judge Joseph Fahey’s court.
In March 2009, Castor was convicted of murder in the second degree, attempted murder in the second degree and offering a false instrument for filing in the first degree.
The jury ruled she intentionally poisoned David Castor with anti-freeze and attempted to kill her daughter, Ashley Wallace, by giving her a cocktail laced with drugs.
Stacy Castor also wrote a false suicide note for her daughter, which stated that her daughter had killed both her father and stepfather.
