Rochester, N.Y. - The man who raped a comatose woman at a Brighton nursing home could get out of prison today.

John Horace, 69, has been in prison for the 1995 attack.

The victim died a year after giving birth to a baby boy.

The Office of Mental Health, which oversees sex offender evaluations, did not refer Horace for a civil confinement proceeding--which could have held him beyond his sentence.
